Welcome to Tournity (“Platform”, “we”, “our”, “us”), operated by GOLDEN COAST TRAVEL LTD. These Terms of Service (“Terms”) govern your access to and use of the Tournity website and booking services.
By accessing our platform or making a reservation through Tournity, you confirm that you have read, understood, and agree to be bound by these Terms.
GOLDEN COAST TRAVEL LTD operates Tournity solely as a booking intermediary and marketplace platform.
We do not own, operate, manage, or control any tours, activities, vessels, vehicles, or experiences listed on the platform.
All services are provided by independent third-party Providers, who bear full responsibility for the execution, safety, insurance, and legal compliance of their services.
Any payment made to Tournity at the time of booking constitutes a reservation service fee (platform commission) only.
This fee covers online booking services, customer support, platform infrastructure, and intermediary services provided by Tournity.
The reservation service fee is non-refundable, unless expressly stated otherwise.
The execution of the service, including operational delivery, safety standards, insurance coverage, and regulatory compliance, remains the sole responsibility of the Provider.
Unless otherwise stated, the remaining balance of the service price is payable directly to the Provider on the day of the activity.
Each Provider listed on Tournity is solely responsible for:
• obtaining and maintaining all required licenses, permits, and authorisations
• holding valid and sufficient insurance coverage
• ensuring the safety, quality, and lawful operation of services
• employing qualified staff, captains, guides, and crew
• complying with all applicable tourism, maritime, transport, and safety regulations
Tournity does not supervise, manage, or control Providers during service delivery.
Customers are strongly advised to:
• request current licenses and insurance documents directly from the Provider
• verify that the service or vessel matches the booking confirmation
• follow all safety instructions and Provider rules
• where applicable, sign a direct agreement or waiver with the Provider
Failure to follow these recommendations may limit the Customer’s ability to assert claims against Tournity.
While Tournity carefully selects Providers, we may not be physically present to verify documentation prior to each service.
All accidents, injuries, deaths, damages, losses, delays, or service failures occurring during the execution of the service are the sole responsibility of the Provider.
Tournity shall not be liable for any such events.
Tournity’s liability is strictly limited to direct damages arising solely from its booking services and shall in no event exceed the total reservation service fee paid by the Customer.
Providers may not substitute vessels, vehicles, or core service elements without prior written consent from Tournity.
If a Provider operates with unregistered, uninsured, or unauthorized equipment, the Provider shall be solely liable.
The Provider agrees to indemnify and hold harmless Tournity (GOLDEN COAST TRAVEL LTD) against any claims.
If a Provider cancels a service, Customers may be eligible for a refund of the reservation service fee at the sole discretion of Tournity.
If a Customer cancels, the reservation service fee remains non-refundable.
Refunds of balance payments made directly to Providers are subject exclusively to the Provider’s own policies.
Tournity shall not be liable for delays, changes, or cancellations caused by events beyond reasonable control, including but not limited to severe weather, natural disasters, government actions, strikes, pandemics, or security risks.
Providers are independent contractors and are not employees, partners, agents, or representatives of GOLDEN COAST TRAVEL LTD.
No partnership, joint venture, or employment relationship is created by these Terms.
Tournity shall only be liable for damages resulting from intentional misconduct or gross negligence directly related to its booking services.
Under no circumstances shall Tournity’s total liability exceed the reservation service fee paid.
Providers agree to indemnify, defend, and hold harmless Tournity (GOLDEN COAST TRAVEL LTD) from any claims, damages, losses, liabilities, or legal costs arising from:
• service execution or failure
• accidents, injuries, deaths, or property loss
• regulatory or legal violations
• third-party claims
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of London, England.
Tournity reserves the right to amend these Terms at any time. Updated versions will be published on the platform with a revised date.
