1. About Tournity
Tournity is an online marketplace for tours, activities and travel experiences. Tournity is operated by GOLDEN COAST TRAVEL LTD, a company registered in England and Wales under company number 16712966 ("Tournity", "we", "us" or "our").
These Terms apply when you browse Tournity, create or use a customer account, submit a booking request or make a booking through our website.
2. Our marketplace role
Tournity acts as a marketplace and booking intermediary connecting customers with independent tour operators, guides, attractions, transport providers and other experience providers (each an "Activity Provider" or "Supplier").
2.1 Role of Tournity
Tournity does not organise, operate or perform the Activities listed on the marketplace. Tournity provides an online marketplace and booking-facilitation service through which independent Activity Providers offer their own services directly to customers.
The contract for performance of an Activity is between you and the Activity Provider identified on the relevant Activity page and/or booking confirmation, unless Tournity is expressly identified as the Activity Provider. The Activity Provider is responsible for delivering the Activity, its personnel, equipment, licences, permits, insurance, safety procedures, operational decisions and compliance with applicable local law.
Golden Coast Travel Ltd may facilitate the booking, transmit booking information, process or collect payment on behalf of an Activity Provider, issue booking confirmations or vouchers, provide customer-support tools and operate the Tournity marketplace. Those marketplace and facilitation services do not mean that Golden Coast Travel Ltd itself performs the underlying Activity or employs the Supplier's guides, drivers, crew or other personnel.
Tournity is responsible for its own marketplace services and for obligations that applicable law places on Tournity. Nothing in these Terms is intended to exclude or limit any responsibility that cannot lawfully be excluded.
3. Eligibility and accounts
You must have legal capacity to enter into a binding contract and must provide accurate, complete and current information when making a booking. If you book for other participants, you confirm that you are authorised to provide their details and to accept these Terms and any Activity-specific conditions on their behalf.
You are responsible for keeping account credentials and booking access links secure and for notifying us promptly if you believe your account or booking information has been accessed without permission.
4. Booking process
Activity pages show the key information available to us, including price, duration, included services, meeting or pickup arrangements, cancellation terms and the identity of the Activity Provider.
When you submit a booking for an Activity, you make an offer to enter into a contract for that Activity with the relevant Activity Provider. Some Activities can be booked immediately. Others use a booking request flow and remain subject to acceptance.
A booking is not confirmed merely because it has been submitted or received by Tournity. The contract for the Activity is concluded when a booking confirmation is issued through Tournity or the Activity Provider otherwise confirms the reservation through the platform.
The booking contract consists of the Activity description and booking details shown at the time of booking, the applicable provisions of these Terms, and any clearly disclosed Activity-specific or Supplier-Customer conditions that you accepted before booking.
Availability can change until confirmation is issued. We may reject or cancel a booking where required by the Activity Provider, payment failure, suspected fraud, technical error, sanctions requirements, legal restrictions or an obvious pricing or availability error.
5. Prices and currency
Prices displayed on Tournity are based on information supplied by the Activity Provider and may vary by date, participant type, option, language, pickup choice, promotion or other booking conditions.
Where Tournity offers currency conversion, converted amounts may be indicative until checkout. Your bank, card issuer or payment provider may apply its own exchange rate or fees. The final amount charged or payable will be shown before you confirm the booking.
Prices available through Tournity may differ from prices offered by the same Activity Provider on its own website, at a local sales point or through another sales channel.
6. Payments
6.1 Pay online securely
Where online payment is available, payment may be processed by Tournity and/or an authorised third-party payment service provider such as a card processor or digital wallet provider. Card details may be entered directly into the payment provider's secure environment and are not required to be stored by Tournity.
When the payment processor confirms a successful payment, Tournity may collect that payment on behalf of the relevant Activity Provider. Your booking remains subject to any confirmation requirement shown during checkout.
6.2 Pay on the tour day
Where the "Pay on the tour day" option is offered, no online payment is taken by Tournity at booking. The booking amount shown becomes payable to the Activity Provider in accordance with the booking confirmation, normally on the day of the Activity. The Activity Provider may specify the accepted payment methods.
6.3 Payment failures
A booking requiring online payment is not treated as paid until the payment is successfully authorised and captured or otherwise confirmed by the payment provider. Failed, reversed or disputed payments may result in suspension or cancellation of the booking.
7. Booking confirmation and vouchers
After confirmation, we may send you a booking reference, voucher and/or confirmation email. You must check the booking details as soon as possible and contact Tournity Support promptly if any material detail is incorrect.
You are responsible for bringing any voucher, identification, licence, ticket or other document stated as required for the Activity.
8. Customer responsibilities
You must follow reasonable safety instructions and the Activity Provider's rules. You are responsible for checking any age, fitness, health, clothing, equipment, licence, identification, visa or other participation requirement stated on the Activity page or communicated before the Activity.
You must arrive at the stated meeting point or pickup location on time. You are also responsible for providing accurate contact, hotel/accommodation and participant information where requested.
An Activity Provider may refuse or end participation where reasonably necessary for safety, unlawful conduct, intoxication, abusive behaviour, failure to meet participation requirements or serious disruption to the Activity.
9. Activity Providers
Activity Providers are independent businesses responsible for operating and delivering their Activities. They are responsible for the operational information, descriptions, inclusions, exclusions, availability and instructions they provide to Tournity, subject to Tournity's marketplace standards and review processes.
The Activity Provider is responsible for performing the Activity with reasonable care and skill and in accordance with applicable law. Activity Providers are independent contractors and are not employees of Tournity. Subject to applicable law, the Activity Provider is responsible for its own acts, omissions, representations, operational decisions, negligence and misconduct in connection with the Activity. Nothing in these Terms limits any rights you may have directly against an Activity Provider under applicable consumer law.
10. Activity-specific conditions
An Activity Provider may publish additional conditions that are specific to an Activity, such as participation requirements, pickup rules, cancellation deadlines, equipment requirements, minimum numbers or operational restrictions. Where they are clearly disclosed before booking, those Activity-specific conditions form part of your booking contract with the Activity Provider.
If an Activity-specific or Supplier-Customer condition conflicts with these Terms on an operational matter concerning the Activity, the more specific condition will generally apply to the contract between you and the Activity Provider. It does not override Tournity's platform, payment or account rules and cannot reduce any mandatory consumer right that cannot legally be excluded. Where two provisions governing the customer-Supplier relationship cannot reasonably be reconciled, the interpretation that preserves the greater mandatory consumer protection will apply.
11. Insurance
Unless the Activity page expressly states otherwise, the booking price does not include personal travel, medical, accident, cancellation, baggage or other insurance for you or other participants. You are responsible for deciding whether appropriate insurance is needed for the Activity and your wider trip.
Any insurance maintained by an Activity Provider is separate from personal insurance you may wish to arrange and does not change any rights or responsibilities that apply under law or these Terms.
Unless Tournity is expressly identified as the Activity Provider, Tournity does not operate the tour or Activity, employ the Supplier's guides or operational staff, or set the Supplier's day-to-day safety procedures.
12. Taxes, local fees and invoices
The price shown at checkout includes the amounts Tournity has been instructed to collect for the booked Activity. Taxes, entrance charges, local levies, port fees or other on-site charges are included only where the Activity page or checkout states that they are included. Any mandatory amount known to us that is payable separately should be disclosed before booking.
Where a receipt, tax invoice or other fiscal document is required for the underlying Activity, it may be issued by the Activity Provider, Tournity or the relevant payment provider depending on the nature of the payment and applicable law. You may contact Tournity Support if you need help identifying the appropriate issuer.
13. Changes to activities
Operational details can sometimes change. Meeting points, pickup times, routes, order of stops, vehicles, vessels or similar details may be reasonably adjusted for safety, weather, traffic, local restrictions or operational reasons, provided the core nature of the booked Activity is not materially changed.
If a material change is required before the Activity, we or the Activity Provider will try to notify you using the contact details supplied with the booking and will explain any available alternatives or refund options.
14. Customer cancellation and refunds
The cancellation policy shown on the Activity page and booking confirmation applies to your booking. Unless a different Activity-specific policy is clearly displayed, you may cancel up to 24 hours before the scheduled Activity start time for a full refund of the amount paid online for the cancelled booking.
For cancellations made less than 24 hours before the scheduled start time, the booking is generally non-refundable unless applicable law requires otherwise or the Activity Provider agrees to a different outcome.
Refunds for online payments are normally returned to the original payment method. Processing times depend on the payment provider and your bank or card issuer. For "Pay on the tour day" bookings, no online payment may exist for Tournity to refund.
If an Activity page displays a different cancellation deadline or condition, that Activity-specific condition applies to the booking, subject always to rights that cannot legally be excluded.
Unless the Activity page states otherwise, cancellation cut-off times and other Activity deadlines are calculated using the local time zone of the Activity Provider or destination where the Activity takes place.
15. Statutory cancellation rights and leisure activities
Some consumer contracts made online normally carry a statutory cooling-off right. However, under UK consumer law, the usual cancellation right does not generally apply to services related to leisure activities where the contract provides for a specific date or period of performance. Many tours and activities booked through Tournity fall within that category.
This does not remove any cancellation or refund right that is expressly offered on the Activity page, in the booking confirmation, by the Activity Provider, or that applies under other mandatory consumer law. The cancellation policy presented for your Activity therefore remains important and should be reviewed before booking.
16. Further rights of the Activity Provider
An Activity Provider may cancel where reasonably necessary because of unsafe weather, insufficient operational conditions, government restrictions, strikes, technical or safety problems, force majeure, or other circumstances outside the Provider's reasonable control that prevent, materially hinder or endanger the Activity.
If the Activity Provider cancels and no acceptable alternative is agreed, amounts paid online for the cancelled Activity will normally be refunded. Tournity is not responsible for separate travel, accommodation or other consequential costs unless applicable law requires otherwise.
The Activity Provider may refuse or end participation if you do not meet clearly disclosed participation requirements, if your participation would create a material safety risk to you or others, or if you seriously disrupt the Activity. In those circumstances, a refund may not be due unless applicable law requires otherwise.
The Activity Provider may make reasonable, non-material operational changes where necessary because of weather, traffic, local restrictions, safety or other unforeseen circumstances. These may include changes to the route, order of stops, vehicle or vessel, pickup arrangement, starting point or meeting point, provided the essential nature of the Activity is not materially changed.
Where practicable, significant operational changes known in advance will be communicated using the email address, phone number, customer account or other contact details associated with the booking. You are responsible for checking booking-related communications before the Activity.
17. No-shows and late arrival
If you fail to attend, miss the pickup, arrive too late to participate or cannot take part because you do not meet a clearly disclosed participation requirement, the booking may be treated as a no-show and may be non-refundable.
18. Events outside reasonable control
Neither Tournity nor an Activity Provider is responsible for a failure or delay caused by events outside reasonable control, such as severe weather, natural disaster, war, civil unrest, government action, public-health restrictions, strike, transport disruption or similar events. Any refund or rescheduling rights will depend on applicable law and the circumstances of the affected booking.
19. Reviews and user content
If you submit a review, photo or other content, you confirm that it is based on a genuine experience, is lawful and does not infringe third-party rights. Reviews must not be fraudulent, misleading, abusive, discriminatory, defamatory, promotional or submitted in exchange for an undisclosed incentive.
You retain ownership of your content but grant Tournity a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, translate, format and use that content for operating and promoting the Tournity marketplace, subject to applicable law and our Privacy Policy.
We may moderate or remove content that violates these Terms, our review rules, applicable law or the rights and safety of others.
20. Prohibited use
You must not misuse Tournity, attempt unauthorised access, interfere with platform security, use automated means to scrape or overload the service, make fraudulent bookings, submit false payment information, impersonate another person, or use Tournity for unlawful activity.
21. Account suspension and termination
We may restrict, suspend or close an account where reasonably necessary to protect customers, Activity Providers or the platform, including in cases of suspected fraud, payment abuse, security risk, repeated breaches of these Terms, unlawful conduct, sanctions or other legal requirements.
Where reasonably practicable, we will consider the effect on existing confirmed bookings and provide notice or an opportunity to resolve the issue. Suspension or closure does not remove payment obligations, refund rights or other rights and liabilities that arose before the account action.
22. Intellectual property
The Tournity name, marketplace design, software, databases and Tournity-created content are protected by intellectual-property laws. Supplier-provided text, images and trademarks remain subject to the rights of their respective owners. You may use Tournity only for personal or legitimate business purposes connected with browsing and booking Activities.
23. Privacy and data protection
We process personal information in accordance with our Privacy Policy and applicable data-protection law, including the UK GDPR and the Data Protection Act 2018 where applicable. We may share information necessary to fulfil a booking with the relevant Activity Provider and authorised service providers.
GOLDEN COAST TRAVEL LTD is registered with the UK Information Commissioner's Office (ICO), registration number ZC057541.
24. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights that cannot be excluded.
Because the Activity itself is performed by the independent Activity Provider, Tournity is not responsible for the Provider's acts or omissions except to the extent Tournity is legally responsible for its own acts, omissions, marketplace services or representations.
To the fullest extent permitted by law, Tournity is not liable for indirect or consequential losses that were not reasonably foreseeable when the booking contract was made, or for losses caused by information supplied incorrectly by the customer or Activity Provider.
25. Assignment
You may not transfer a booking or your rights under these Terms to another person where that would conflict with an Activity Provider's participation, identification or security requirements, unless Tournity or the Activity Provider agrees or applicable law gives you that right.
We may transfer our rights and obligations under these Terms as part of a corporate reorganisation, financing, sale of business or similar transaction, provided that doing so does not reduce mandatory consumer rights or materially prejudice an existing booking.
26. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary and the remaining provisions will continue to apply.
27. Notices and communications
Booking confirmations, operational updates, payment notices and other communications may be sent to the email address, phone number, customer account or other contact method supplied with the booking. You are responsible for keeping those details accurate and for checking messages relating to an upcoming Activity.
Where these Terms require you to contact Tournity, you may use the Help Center or the contact details in section 31. Formal notices from us may be delivered electronically where permitted by law.
28. Customer support and complaints
If a problem occurs during an Activity, you should raise it with the Activity Provider as soon as reasonably possible so they have an opportunity to help. You can also contact Tournity Support through our Help Center.
For booking-specific support, include your booking reference and the email address used for the reservation. We may need to share the complaint with the Activity Provider in order to investigate and respond.
29. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, without depriving you of any mandatory consumer protections that apply in the country where you normally live.
If you are a consumer, you may have the right to bring proceedings in the courts of your place of residence where mandatory law provides that right. Otherwise, the courts of England and Wales will have jurisdiction, subject to applicable law.
30. Changes to these Terms
We may update these Terms to reflect changes to our services, law, payment methods or marketplace operations. The version that applies to a booking is normally the version in effect when the booking is made, unless a change is required by law.
